PURCHASE CONDITIONS

Impetus retail, Lda reserves the right not to process orders received from users who are not “Final Clients”, or those who are not in compliance with the general sale conditions.
The “Client” must supply Impetus Retail, Lda with a valid email address and, at least, one telephone contact, which must correct and complete. The client also accepts to be contacted, if necessary.


Right to not accept the order or cancel the purchase
Impetus retail, Lda reserves the right to refuse any order for any motive. We also reserve the right to cancel any purchase (even if it has already been accepted by us), in the following conditions, without being responsible for any damages or costs:
*The product is no longer available/in stock (payments shall be refunded);
* Invoice information is not correct or verifiable;
* The order is signalled by our Security Systems as an incorrect order or an order susceptible to fraud;
*Transfer for the payment of the order was not received in a period of 7 business days after accepting your order;
*If we discover that the Client is under 16 years of age;
*If we discover that the Client is a retailer;
*If there is an error in the price quote;
*If it is impossible to deliver to the address supplied.


Security of the Order

The Impetus online store uses the latest protection against fraud.
Your payment information is encrypted as soon as you login until your transaction is processed and it is not saved on a public server.
Although we use encryption software, the security of the information and the payment through the internet or through email can not be guaranteed. Impetus Retail, Lda. cannot be held responsible for any damages suffered as a result of the use of electronic communication methods, including, but not limited to, recurrent lapses or delays in the delivery of electronic communications, interceptions or manipulations of the electronic communications by third parties or computer programmes used for the communication or transmission of viruses.

If you choose to pay by bank transfer, we begin to process the order after we have received the payment. This can take up to several days. If 7 calendar days elapse since the placing of the order without receiving any sort of payment, then the order will be considered cancelled. Payments can only be processed if the information used for invoicing can be verified.


Reservation of Ownership
Impetus Retail, lda. retains ownership of the company’s products until it has received a full payment.


Prices
The prices of the products displayed on the site include Value Added Tax (VAT). The shipping fees are applied to the order. The exact price of the shipping charges depends on the country origin of the Client. For additional information regarding shipping charges by country, please consult the Information section of the site.
The prices are all quoted in Euros. Please note that a change on the country of origin of the Client can influence the prices of the products as well as the shipping charges.


Your total cost
The total cost specified in the final checkout menu includes taxes and shipping charges. The prices are quoted at the time of the order’s confirmation. Please transfer only the exact amount specified at the time of the order’s confirmation and make separate, individual transfers for each order.


Changes in price

The prices of the products presented on this site are subject to change. Impetus Retail, Lda reserves the right to alter prices without previous warning. The prices displayed at the time of purchase are the prices applied to that purchase. Except in case of computer error.


Price errors
Please be aware that even though the site is updated with extreme care and attention, it is possible that the information about a price may contain errors. Impetus Retail, Lda cannot be held responsible for honouring that price and reserves the right to cancel your order, in case of an error.


Quality and Guarantee
Impetus Retail, Lda does not sell second hand products, products with defects or of an inferior quality to the standards held in the market.
The products displayed for sale on the site may not exactly correspond to the actual garments in terms of image and colours, due to Internet browsers and the monitor used.
In case you decide to return the purchased products, Impetus Retail, Lda reserves the right to not accept it if the products are returned without their corresponding tag or seal, or if they have been altered relative to their original state or are damaged.


Shipping and Delivery
Delivery: where and when
We deliver products from Monday through Friday. We do not make deliveries on specific holidays or weekends. We can only deliver an order if the delivery address is a house or office in one of the countries mentioned in the available country list.
A delivery is considered carried out or a product is considered delivered with the signing of the delivery receipt at the address agreed upon.


Delivery Times: 1 to 5 business days*

If the order is confirmed on a business day before 12:00pm and payment is made with Paypal/Credit Card, then the order will be shipped in the following 24h-48h (weekends and holidays are not considered business days). If payment is made via bank transfer, the delivery method is less efficient being that the product is only shipped after we receive the payment. This can take up to 5 to 7 days. Impetus Retail, Lda cannot be held responsible for the nonfulfilment or delay in fulfilment of any obligation due to any event, act or omission beyond our reasonable control. (Includes any event, act or omission beyond the reasonable control of the “Vendor”).
*We shall try to deliver in the foreseen time, it being commercially feasible. Normally, we shall always proceed in this manner; however, we can not guarantee a timely delivery.


Partial Delivery
Whenever possible, we try to deliver all items in one shipment. However, we reserve the right to divide the shipment of the order. For example, this would occur (but is not limited to) part of an order being delayed or unavailable. If we proceed to divide an order, the client shall be notified, by email of our intention to proceed in this manner. To such an effect, we shall use the email address supplied by the client at the time of the order.


Inspection upon delivery
At the time of delivery, the client may inspect the package to check for possible damage. If the client determines that the items have been damaged, he should not accept the package and should begin the return process as soon as possible. Impetus Retail, Lda shall proceed with reimbursing the value of the order and the shipping costs as soon as the warehouse receives the package and completes the return procedure.
After receiving the order, it is imperative that the client verify the delivered items in a period of 30 days, because after that time Impetus Retail, Lda considers that the client accepted the product(s).


Shipping Fees
The shipping fees are applied to each order. The exact price of the shipping charges depends upon the order country of origin. For more details regarding shipping charges by country, please consult the Information menu of the site.
For countries outside the European Community (for example, Brazil, U.S.A. Russia, amongst others) all the costs pertaining to customs taxes are of the client’s responsibility.


Custom duties
It is the buyer's responsibility for any custom duty fees that may be charged upon delivery. How the import duty will be charged depends on each country’s custom policies


Free shipping

If a client places an order whose value exceeds the minimum defined for their country or by the campaign, then the delivery shall be made without any additional cost, in other words, free shipping.


Returns and Cancellations
Order cancellation before shipping
The client may cancel an order without any associated costs, as long as the order has not yet been processed. If a client has placed an order and intends to cancel it, they must first verify the status of the order in the “My Order” menu located on the upper right-hand corner of the site’s homepage. If the order’s status is labelled as “Awaiting Payment” or “Payment Accepted” there is still a possibility of cancelling the order. However, the client should contact our Customer Service to request the cancellation of the order. Only after this procedure is it possible for our Customer Service Department to request the cancellation of the order in the warehouse. If the cancellation request is successful, the client shall be notified via email and the cancellation shall be processed without cost to the client. If the cancellation is not possible the items shall be sent to the client. If it is still the client’s intention to cancel the order, they should not accept the delivery of the package containing those items. However, the client may proceed with returning the items according to the terms and conditions stipulated below.
It’s possible to return it up to 14 days after the delivery. After that deadline, Impetus reserves the right not to accept returns.
The Impetus Underwear Online Shop does not accept direct product exchanges, but we return the price of the articles, in which case you can make a new purchase with the article size and colour you want.
If the article purchased is defective, you should return it, stating the reason and the defect found in the article when submitting your return.
If our Quality Department attests the defect or non-conformity of the article with what is shown in the online shop as justification for the return, we will proceed with the full refund of the price paid for the article, since we do not ship a new article.
The submission of the return request at the Online Shop is mandatory, otherwise we cannot process your return correctly, or refund the amount corresponding to your return.
How do I make a return at the Online Shop:
1. You must submit your return online in your client area by clicking on “Returns” and then on “New Return”.
2. Select the order number that you wish to return.
3. From the list of articles, check only the articles you wish to return, and delete the ones you don’t wish to return.
4. If you wish, you can enter all the additional information you consider to be relevant in the comments box.
5. Submit.

How is the return processed after the submission is made:
Place the article(s) in the original packaging or, if you no longer have it, in a package suitable for its safe transport. The Client is fully responsible for any damages caused to the product should the return shipping of the article be done using a packaging different from the one in which the article was received. The articles, together with the invoice, must be sent by post to the following address:

The refund will be made within 15 working days from the date of receipt of the returned product, through the same payment method originally use.

Impetus Retail, Lda reserves the right to alter the present Purchase Conditions at any time.
The Client is subject to the principles and terms in vigour at the time of the order placement, unless the law or some other competent entity imposes some alterations.
